Welcome to Dayravel. These Terms of Service (“Terms”) form a legally binding contract between you (“User”, “you”, or “your”) and Dayravel (“Dayravel”, “we”, “our”, or “us”) covering your access to and use of Dayravel.com (“Web Platform”) and our iOS and Android mobile applications (collectively, the “Service”).
By accessing, browsing, downloading, or using any portion of the Service, you signify your full agreement to these Terms. If you do not agree to every provision, you are strictly prohibited from using the Service and must immediately discontinue use.
1. Platform Architecture & Mobile App Experience
Dayravel delivers tailored destination discovery across multiple client applications:
Mobile Apps (iOS & Android)
Our mobile apps currently operate in a 100% account-free, anonymous discovery mode. There is no user registration, no login modal, and no collection or transmission of personal identity data. Device preferences remain entirely on your local hardware.
Web Platform (Dayravel.com)
Users can explore anonymously or optionally create a verified account to synchronize saved travel bookmarks, customize regional preferences, and personalize itineraries.
2. Absolute Travel Advisory Disclaimer & User Responsibility
DAYRAVEL IS AN INFORMATIONAL DESTINATION DISCOVERY PLATFORM ONLY. We are not a licensed travel agency, airline, consular authority, immigration attorney, emergency responder, or medical provider.
- Visa, Passport & Entry Rules: Visa policies, entry prerequisites, transit visas, and reciprocal travel treaties change frequently without notice. You are solely and exclusively responsible for confirming current visa eligibility with official embassies, consulates, and government immigration departments before purchasing travel.
- Safety, Weather & Local Laws: Weather estimates, safety advisories, air quality indicators, and budget approximations are compiled for general reference. Real-world conditions, extreme weather, civil unrest, and border closures are beyond our control.
- Independent Confirmation: You acknowledge that any reliance on information provided through the Service is strictly at your own risk. Dayravel assumes zero legal or financial liability for denied boarding, deported entry, travel delays, financial losses, illness, or personal injury.
3. Account Registration & Credential Security
If you create an account on Dayravel.com:
- You must be at least 13 years of age (or the minimum legal age in your jurisdiction).
- You agree to provide accurate, current, and complete registration information.
- You are solely responsible for maintaining the confidentiality of your password and authentication credentials. Any activity conducted under your account is your legal responsibility.
- You must notify Dayravel immediately at [email protected] if you suspect unauthorized access.
- Dayravel reserves the absolute right to suspend, terminate, or deactivate accounts that violate these Terms or engage in abusive, deceptive, or malicious behavior.
4. Intellectual Property & Prohibited Activities
The Dayravel trademarks, logos, UI designs, software architecture, curation algorithms, and proprietary intelligence datasets are the sole intellectual property of Dayravel and protected by international copyright, trademark, and trade secret laws.
You agree that you will NOT:
- Use any robot, spider, crawler, scraper, or automated tool to extract data, text, or images from the Service without express written permission.
- Reverse engineer, decompile, disassemble, or derive the source code or proprietary discovery models of the Service.
- Bypass, disable, or circumvent any rate-limiting, authentication, or security barriers implemented by Dayravel.
- Frame, replicate, mirror, or create derivative works designed to mimic Dayravel's brand or platform identity.
5. Complete Limitation of Liability & Warranty Disclaimer
IN NO EVENT SHALL DAYRAVEL, ITS FOUNDERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF REPUTATION, MISSED FLIGHTS, CANCELLED RESERVATIONS, EMBASSY REJECTIONS, PHYSICAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE.
TOTAL LIABILITY CAP: IN ANY CIRCUMSTANCE, DAYRAVEL'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE SHALL BE STRICTLY LIMITED TO THE AMOUNT YOU PAID TO DAYRAVEL IN THE PRECEDING TWELVE (12) MONTHS, OR TEN UNITED STATES DOLLARS ($10.00 USD), WHICHEVER AMOUNT IS LESS.
6. Dispute Resolution & Class Action Waiver
MANDATORY BINDING INDIVIDUAL ARBITRATION: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding, confidential individual arbitration rather than in court, except that you may assert claims in small claims court if eligible.
CLASS ACTION WAIVER: YOU AND DAYRAVEL AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. NO ARBITRATOR MAY CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS.
7. Third-Party Links & Photography
Dayravel features visual assets sourced through licensed commercial repositories (such as Pexels) and may provide external hyperlinks to third-party travel resources. We do not endorse, operate, or assume responsibility for external websites, their accuracy, or their privacy practices.

8. Modifications & Governing Law
We reserve the right to amend these Terms at any time by posting the revised version with an updated “Last Updated” date. Continued use of the Service following revisions constitutes your acceptance of the amended Terms.
